1. Agreement

These Terms of Service ("Terms") govern your access to and use of the website at www.dgreenlan.shop (the "Site") operated by DGREEN LANDSCAPE & EXCAVATION LLC ("DGreen", "we", "us"), a Utah limited liability company located at 4221 S 4580 W, West Valley City, UT 84120, United States. By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Nature of the Site

The Site is a general-information publication describing the company's service capabilities across six sheets: architecture and land planning, consulting engineering, drafting, inspection, surveying and mapping, and testing laboratories.

3. Site Information and Field Data

Descriptions of surveying, geotechnical, and testing capabilities are general statements of capability — not representations of conditions at your site. Subsurface and environmental conditions vary; only project-specific investigation under a written scope can characterize a particular parcel.

4. Permitted Use

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in any way that violates applicable law or regulation;
• Scrape, crawl, or harvest Site content or data by automated means without prior written consent;
• Attempt to probe, scan, test, or compromise the Site or its hosting infrastructure;
• Submit false, misleading, or impersonating information through the scope form;
• Transmit malware, spam, or unsolicited commercial communications;
• Interfere with other users' access or with the operation of the Site.

5. Intellectual Property

The Site and all content on it — text, structure, design, the plan-set design system, illustrations, and code — are the property of DGREEN LANDSCAPE & EXCAVATION LLC or its developer DGREEN L, and are protected by copyright and other intellectual-property laws. You may view and print pages for personal, non-commercial reference only. Any other reproduction, redistribution, or derivative use requires prior written consent.

6. Information You Submit

By submitting a form or email you represent that the information provided is accurate and that you have the right to share it. You grant us a non-exclusive right to use submitted information — including site and parcel locations — to evaluate and respond to your request. Do not submit documents you are not authorized to share; plan sets and reports are exchanged under scoping correspondence, not through the web form.

7. Third-Party Services

The Site is hosted by Google Firebase and its domain is registered through Spaceship. We are not responsible for the acts, omissions, availability, or policies of third-party providers. Links or references to third parties do not imply endorsement.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DGREEN LANDSCAPE & EXCAVATION LLC, ITS MEMBERS, MANAGERS, AND DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR PROJECT DELAYS — ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Liability for professional services, if any, is governed exclusively by the applicable written agreement.

10. Indemnification

You agree to indemnify and hold harmless DGREEN LANDSCAPE & EXCAVATION LLC and its members, managers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.

11. Confidentiality Notice

Communications with us through the Site are not guaranteed confidential. Project engagements carry their own confidentiality and ownership-of-documents terms under written agreement, which supersede this section for the matters they cover.

12. Termination and Changes

We may modify these Terms at any time; the revised Terms take effect when posted with an updated revision date. Continued use of the Site after posting constitutes acceptance. We may suspend or discontinue any part of the Site without notice.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. The exclusive venue for any dispute arising from the Site or these Terms is the state or federal courts located in Salt Lake County, Utah.

14. Miscellaneous

If any provision of these Terms is held invalid, the remainder continues in force. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and DGreen regarding the Site.
